This website is operated by Pioneer Giant LLC, a Nevada limited liability company with a mailing address at 732 S 6th St, Ste N, Las Vegas, NV 89101, United States. In these terms, “we,” “us” and “our” refer to Pioneer Giant LLC.

2. The site is informational

pioneergiant.com exists to describe our company. It is not a store, it does not take orders, and it does not provide accounts or hosted services. Nothing on this site is an offer to sell, a commitment to release any particular product, or a representation about the timing, pricing, features or availability of any software. Descriptions of our work reflect our plans at the time of writing and may change without notice.

3. Descriptions of our approach are not warranties

Passages on this site describing how we build, design, price, support or distribute software, including the sections headed “The standard we build to” and “The studio” on the homepage, state general priorities and current intentions. They are not warranties, guarantees, performance claims or contractual terms; they do not describe every application; and they may change as products and circumstances do.

The binding terms for any application are those presented with that application: its license agreement, its own privacy policy, and the information published on its store listing, including its price, its supported platforms and its declared privacy practices. Where anything on this site differs from that material, the material supplied with the application governs. Please rely on it rather than on this site.

4. Intellectual property

The contents of this site (including its text, layout, design, code and the Pioneer Giant name and mark) are owned by Pioneer Giant LLC and protected by copyright, trademark and other laws. You may view, quote briefly with attribution, and link to this site. You may not copy it wholesale, reproduce it as your own, or use our name or mark in a way that suggests we endorse or are affiliated with you, without our prior written permission.

5. Software is licensed separately

Applications published by Pioneer Giant LLC are not distributed through this site and are not covered by these terms. Each application is licensed under the agreement presented with it. For software distributed through a third-party store, that is generally the store's standard end user license agreement together with any additional terms we supply on the listing.

6. Acceptable use

Please do not attempt to gain unauthorized access to this site or the systems that serve it, interfere with its operation, scrape it in a way that burdens our hosting, or use it for any unlawful purpose.

7. External links

This site may link to resources we do not operate. We provide those links for convenience only. We do not control those resources, and we are not responsible for their content, availability or practices.

8. No warranty

This site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that the information on it is complete, accurate or current.

9. Limitation of liability

To the fullest extent permitted by law, Pioneer Giant LLC and its members, managers and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your use of this site, whether based in contract, tort, strict liability or any other theory, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain of these exclusions, in which case they apply to you only to the extent permitted.

We may update these terms from time to time. When we do, we will change the date at the top of this page.

11. Governing law

These terms are governed by the laws of the State of Nevada, United States, without regard to its conflict of laws rules. You agree that the state and federal courts located in Clark County, Nevada have exclusive jurisdiction over any dispute arising out of or relating to these terms or this site. Nothing here deprives you of any protection you have under the mandatory law of the country in which you live.

12. Severability

If any provision of these terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force.
